Litigation

LITIGATION

At Al Mushiri Law Office, we pride ourselves on offering comprehensive legal services in all contentious matters tailored to meet the needs of our diverse clientele. While we prioritise cost-effective and amicable resolutions, we recognise that litigation is often an unavoidable avenue. As a fast-growing local law firm, our legal team is equipped to manage cases across a wide spectrum of sectors and at all levels of legal proceedings. Our demonstrated expertise, underscored by the hundreds of successful outcomes achieved since the firm’s inception.

Our practice encompasses the entirety of Qatar’s judicial system, offering clients robust representation from the earliest stages of litigation to final appeals. We adeptly navigate the following courts:

1- Criminal Courts

Comprising the Lower Criminal Court and the Higher Criminal Court, these courts adjudicate offenses ranging from misdemeanors to felonies.

2- Civil Courts

  • These courts handle a wide range of disputes, including civil and commercial cases, family law matters (such as divorce, custody, and inheritance), personal status issues, administrative disputes, and labour disputes. The Administrative Court, under civil jurisdiction, addresses disputes involving public authorities, government decisions, and regulatory compliance. Similarly, the Labour Dispute Resolution Committees, which also fall under civil jurisdiction, manage employer-employee conflicts, wage disputes, workplace grievances, and other employment-related issues.

3- Court of Appeal

This court reviews appeals against decisions from the aforementioned courts and committees, ensuring that justice is appropriately administered.

4- Court of Cassation

As the highest judicial authority, it addresses complex legal questions and ensures the correct application of law across all cases.

The Investment and Trade Court

In addition, our lawyers possess extensive experience representing clients before the Investment and Trade Court. The Investment and Trade Court, established in 2021 and effective as of 10 May 2022, serves as a specialised forum for resolving complex disputes in sectors such as construction, banking, intellectual property, service agreements, and financial investments. At Al Mushiri Law Office, we have been representing clients before the Court since its inception. With a deep understanding of its jurisdiction and procedures, our legal team provides strategic and tailored advocacy to protect our clients’ interests at every stage of litigation.

For cases that progress through the judicial system, our approach ensures seamless advocacy, from the First Instance Court to the Court of Cassation, with a focus on safeguarding our clients’ interests at every stage.

At Al Mushiri Law Office, we understand that securing a favourable judgment is only the beginning of the legal process. Effective enforcement is critical to ensuring that the outcomes achieved in court are translated into tangible results. Qatar’s Enforcement Court, established under Judicial Enforcement Law No. 4 of 2021, plays a pivotal role in this regard. This specialised court replaced the former Enforcement Department under the Civil and Commercial Procedures Law, streamlining the enforcement of judgments, arbitration awards, and other writs of execution.

Our experienced legal team is well-versed in enforcement proceedings, both locally and internationally. Whether addressing the enforcement of domestic judgments or navigating the complexities of cross-border compliance, we provide strategic, results-oriented advocacy to protect and advance our clients’ rights. From initiating enforcement actions to managing post-judgment procedures, we work tirelessly to ensure our clients achieve the outcomes they deserve.

Qatar Financial Centre (QFC): Civil and Commercial Court

We also provide expert legal counsel to clients operating within the Qatar Financial Centre (QFC). The QFC offers a specialised legal framework designed to support international business operations. Within the QFC, the Qatar International Court and Dispute Resolution Centre (QICDRC) stands as a distinguished judicial institution specialising in civil and commercial disputes. Designed to uphold the highest standards of international best practices, the Civil and Commercial Court features a panel of globally renowned judges with extensive expertise in dispute resolution. Its state-of-the-art courtroom is equipped with advanced technologies, including virtual hearing capabilities, allowing litigants and legal professionals to participate in hearings and trials remotely, ensuring efficient access to justice.

The Court’s operations are overseen by its dedicated Registry team, led by the Registrar, who is responsible for managing all aspects of case administration. Supported by expert case managers and staff, the Registry provides comprehensive assistance to litigants and practitioners, guiding them through the procedural requirements and practices of the Court to ensure a seamless and transparent judicial experience.

Our expertise includes:

  • Navigating contractual disputes and regulatory compliance issues specific to the QFC.
  • Representing clients in commercial, and civil disputes before the Qatar International Court, before both the Court of First Instance and the Appellate Division.
  • Advising on QFC-specific arbitration and alternative dispute resolution mechanisms to achieve efficient and cost-effective resolutions.

At Al Mushiri Law Office, we combine deep legal expertise with a relentless commitment to client service, ensuring that our clients receive unparalleled representation and strategic advice at every stage of their legal journey.
